MINNEAPOLIS – The Department of Homeland Security is lying about several of the people it has detained in Minnesota, according the Minnesota Department of Corrections.

"DHS is justifying an unprecedented federal deployment into Minnesota communities based on the demonstrably false narrative that Minnesota refuses to honor ICE detainers,” according to the Minnesota DOC. "What is troubling is DHS taking credit for 'arrests' which are, in reality, state-to-federal handoffs occurring at prison facilities after individuals complete their state terms of imprisonment, as has been the long-standing practice."

Corrections officials in Minnesota found DHS falsely claimed it had arrested up to 68 people in Minnesota. The DHS website lists almost 490 people total that it says were arrested by the department.

Of those 68, at least 2 were convicted of and were serving time in a Minnesota prison for sexual assaults against children.

Jose Eliborio Ocampo-Leon, 40, was convicted of felony first-degree criminal sexual conduct including penetration with a child under 16 years old while in a significant relationship. Case number 27-CR-19-11002.

He was sentenced to 10 years in prison in November 2019. He only served about half of his sentence before ICE picked him up from the Moose Lake prison on Jan. 22, 2026.

Pao Xiong, 46, was also convicted of felony first-degree criminal sexual conduct including penetration with a child under 16 years old while in a significant relationship. Case number 62-CR-17-1995.

He was sentenced to 13 years in prison in September 2017. He served a little more than 8 years of his sentence before ICE picked him up from the Faribault prison on Nov. 17, 2025.

Typically defendants serve about two-thirds of their prison sentence in Minnesota before being released on probation, depending on good behavior. Neither men served that amount of time before ICE took them from prison to release them in their country of birth.
